Welcome to Noteify. These Terms and Conditions ("Terms") govern your access to and use of the Noteify mobile application and its services (collectively, the "Service"). Please read these Terms carefully.

By creating an account or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

1. User Accounts

  • Age Requirement: You must be at least 13 years old to create an account and use the Service. By creating an account, you represent and warrant that you meet this age requirement.
  • Account Security: You are responsible for safeguarding your account information, including your password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2. User-Generated Content

You are solely responsible for the content you create, upload, post, or display while using the Service ("User Content"). This includes your posts in the "Friends Circle," comments, images, notes, and documents.

  • Ownership: You retain ownership of your User Content.
  • License to Us: By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, reproduce, modify, display, and distribute your User Content solely for the purposes of operating, providing, and improving the Service.
  • Responsibility: You agree that your User Content will not violate any laws or infringe on the rights of any third party.

3. Acceptable Use and Content Rules

We want Noteify to be a safe and productive space. You agree not to post User Content or engage in any activity on the Service that:

  • Is illegal, fraudulent, or promotes illegal activities.
  • Contains hate speech, incites violence, or is threatening, harassing, or abusive.
  • Contains nudity or sexually explicit material.
  • Constitutes spam, phishing, or unsolicited commercial communications.
  • Infringes on the intellectual property rights (e.g., copyright, trademark) of others.
  • Involves impersonating any person or entity.
  • Contains viruses, malware, or other malicious code.

4. Content Moderation and Enforcement

We provide tools for you to report and block other users. While we are not obligated to monitor all User Content, we reserve the right to review it.

We may, at our sole discretion, remove any User Content and suspend or terminate your account without prior notice if we believe you have violated these Terms.

5. Termination

  • By You: You can terminate this agreement at any time by deleting your account from the settings screen within the Service.
  • By Us: We may suspend or terminate your access to the Service at any time, for any reason, including but not limited to a breach of these Terms.

6. Third-Party Services

The Service integrates with third-party services, such as Google Firebase, Google AdMob, and the Google Gemini API. Your use of these services is subject to their respective terms and privacy policies.

7. Disclaimers and Limitation of Liability

Please read this section carefully as it limits our liability.

  • "AS IS" Service: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or free from errors.
  • Data Responsibility: You are solely responsible for your data. While we offer a backup feature via Google Drive, we are not liable for any loss or corruption of your data. We strongly encourage you to maintain your own backups.
  • Limitation of Liability: To the maximum extent permitted by law, Noteify and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.

8. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will provide you with notice through the Service or by other means. Your continued use of the Service after the changes become effective constitutes your acceptance of the new Terms.
